As many of you know, last month a U.S. federal judge ordered the Food and Drug Administration to impose a 10-month deadline for the submission of e-cigarette applications (PMTA).
The FDA had proposed the shorter timeline after the U.S. District Court for Maryland ruled that the agency had exceeded its authority in allowing e-cigarettes to remain on the market until 2022 before companies applied for regulatory approval.

Thank you for the chance to provide some feedback, as well as for the discount code. As I highly doubt any of our law makers will look past the bad science, the think of the children fear mongering, and of course, the money, to make rational decisions about vaping legislation, I've been preparing for the ban hammer for a while now. I might not use my code as I already have a pretty large stockpile of your nic base vacuum sealed in my deep freezer, but it is appreciated. Thanks again, and good luck with the paperwork.
I'm sure they're sweating it. I think they were founded along with the rise in the ecig market. Either way, I hope they are able to survive afterwards, but I'm sure the market collapsing (e-cig businesses) will be devasting to their business along with a lot of other flavor companies.
The market isn't gonna collapse, it's just gonna stop growing. But the DIY market (and pseudo-DIY market, like one-shots or shortfills or whatever) will likely end up growing some, assuming flavored juices get pulled from the market.
I can't figure out whether nicotine base itself will require a PMTA (or a different PMTA for each concentration/PG or VG variant), but if it does, or if the FDA disallowed direct to consumer high concentration nicotine sales, it could plausibly collapse.
Honestly it's only a matter of time before someone isn't careful and kills themself or one of their kids with high concentration nicotine base. Think that already happened in Australia, but in the US that'd definitely be a front page story and induce a panic. I wouldn't assume that DIY is safe at all, which is why I have 2 liters of 100mg in the freezer and am just about to order another liter...
How do you see the market surviving?
Demand. I don't see the majority of vapers quitting just because of bad laws. It may be difficult for new tech to become available, but most of us will find a way to obtain or build our own gear. And like in the old days, individual vapers will spread the technology around at a grassroots level. Flavored juices are the least likely to survive, but the commercial juices will likely just release tiny flavor sbots (enough flavor and PG to make a 60ml bottle, just add VG and nic)...since it's impossible to prove it's for vaping. The pod market will survive, since there's bjg money supporting it, but there's only gonna be two or three companies in murica releasing pods, as it'll take a massive investment to get into the market (but it'll be lucrative for years.) Eventually, vaping will be demonstrated to have been the best chance for eliminating smoking, that was not properly supported, and laws will revert to vaping friendly... But that'll be a decade or more out.

Interesting. I guess I never realized it was baited...I mean, I understand paid focus groups, but not coupon value for the product in question. I would think you'd get coupon-chasers.
