Having options allows the product to be changed, which can be considered misbranding, which is enforced on August 8th 2016. Other actual label requirements aren't enforced until August 8th 2018.

Have any sources for this? I've read through sections 902 & 903 and all I don't see anything about multiple nic levels being displayed and having one checked. It says labels may not contain misleading information. If a nic level is clearly marked I don't think that would be misleading.
