Will the Utah online vape ban screw me for DIY?
submitted over 9 years ago by cannibalcastaway

As of july 1, no one in Utah can order ANYTHING vape-related online. Do you guys suggest any workarounds for ordering my flavors and nic? I know i can get pg and vg anytime (along with wire cotton and batteries so, hardware wise, im ok)

Not sure how they would enforce this. Other than telling companies not to ship to thier state, you need a remailer service.

Edit: For example have nic shipped to another state, they slap a label saying "sex lube" on it and mail it to you. Even if someone opens it they won't know it's nic.

So they have remailer services? Like not a homie doing it for you, but a company that does just that as a business?

Well, if there isn't then there's an excellent startup-opportunity.

For sure. I wonder what legality behind it would be like. I just hope we all take care of each other as the shit hits the fan while we roll down this bumpy FDA and local regulations road. Obviously people well known with contacts all other the place will still get their needs meet. But I'd hope that if the average Joe vaper posted or expressed his concern or desire to get something he can't, that he'd immediately get a private message from a trusty fellow vaper that would get him what he needs or allow the guy to get a shipment sent to his house and then forward the package to the state\address in question that's under shipping regulations.

Until they steal it, use it and then die. Lol

That's what they get for stealing someone's vape mail.

Okay okay Google search looks like this bill was defeated before and they're not going to stop online sales but go after people who are selling online to minors.

I'd really like to know where you got this information from so I can fact check it. I live in slc and having one less month before the FDA dropped the hammer is going to suck.

400 (3) The face-to-face sale requirement in Subsection (2) does not apply to: 401 (a) a mail-order, telephone, or Internet sale made in compliance with Section 402 59-14-509;

It says those requirements do not apply if made in compliance with 102 59-14-509, If you go on to read 402 59-14-509 it comes out as "if you don't have a license and try to do this shit this is what can happen to you."

https://le.utah.gov/xcode/Title59/Chapter14/59-14-S509.html?v=C59-14-S509_1800010118000101

(3) (a) Each order or purchase of a tobacco product or cigarettes as defined in Section 59-22-202 in violation of Subsection (2) shall constitute a separate violation under this section. (b) In addition to the penalties in Subsection (4), a person who violates this section is subject to:

(i) a civil penalty in an amount not to exceed $5,000 for each violation of this section;

So just to clarify if I don't have a tobacco license and order something online they're going to give me a $5,000 penalty? I really don't see how make him stop online sales other than trying to scare venders off from sending things to Utah.

Reread this and if I'm understanding this correctly it means that the vendor needs to have a tobacco license.

That's a fine for the vendor apparently.

Get lots of nic now and put it in the freezer. A liter of 100mg/ml goes a long way when you use it in 3% mixes.

I have 3.5 liter in the freezer, nicotine was the one thing I was worried about. And then my mind was put at ease when someone mentioned it was on the market before the grandfather date.

Flavorings shouldn't be an issue either since most of these companies that do make flavorings aren't eliquid specific companies. You may have to order directly from the flavoring company over like "Bullcity Vapor" or any other company with vape in the name.

I made sure to double-check the shipping label on the box from my last delivery before I posted this, but, Bull City Vapor's return address on the label is just BCV, then the address. Also, can't confirm, but, I think Ecig Express ships under ECX. So, might be fine?

What I can confirm is it's time to tie up all these broken-down boxes with twine and put 'em out for recycling. Jesus Christ.

I forgot that they do ship as BCV but was really only using the name as an example. I think your also right about ecx I could search around im sure I have something shipped from them.

Wait what?!? Fuck! I didn't realize that... Another reason to move I guess. The lameness of UT is really now outweighing the upsides of living here.

Destroying the beautiful parts of the state with drilling & industry to line their pockets, but God (or Joe Smith) forbid its citizens can vape.

It isnt the Moe's. It's the vape companies here. They lobbied for this. And of course Mormons are easy to convince. Vape shops here want you to buy their $20 juice.
