Hey guys, I recently noticed a few post about the effects of the new law regarding all tobacco products in europe aka TPD2. Because most information spread on the internet is pretty vague and sometimes not true id like to give you guys a short summary of whats happening with the tpd and what that means for DIY.
First of all, the set of laws by the TPD are a minimum requirement for a country. That means each country is free to create stricter laws then those proposed in the tpd. Also, all companies get a certain time before they have to comply with the rules, so they can sell their current stock. This time period is usually pretty long ranging from 1 year to 5 years because companies like Philip Morris have entire warehouses full of Cigarettes and they have a right to sell whats already made, even if it doesnt comply with the TPD (basically, Big Tobacco is helping us out by increasing the time we have).
Also, all the laws regarding this are only targeting merchants, not consumers. Its Illegal to sell, but legal to own.
- E Liquids that contain Nicotine can only be sold in bottles with a maximum capacity of 10 ml and a child safe lid. E liquids that do not contain Nicotine are not affected by this rule.
- The Maximum Nicotine strength you can sell is 20mg per ml.
- Vapes that are sold "preloaded" with the liquid (read cig-a-likes) are limited to 2ml of e juice. Your usual tank is not affected because its not preloaded. You buy it empty.
That pretty much sums it up. There is a part that talks about aromas and flavouring, but they only restrict flavours that are not considered safe for human consumption. By that definiton, you could buy a liquid that contains diacetyl, because diacetyl is considered safe. So no worries here.
For DIY that pretty much means, you can still just go ahead and buy your stuff normally with the only exception being nicotine. But you can still go ahead and simply buy 10x10ml of 20mg nicotine and put it in a 100ml bottle for better storage.

That's not entirely true and will depend on the specific implementation of each country. While it isn't explicitly in the TPD, there are member states that are considering to treat 0mg e-liquid like the one with nicotine in their drafts for the law (Germany for example).

Only tanks that are sold with liquid containing nicotine are affected by this rule. Afaik only cartridges and cig a likes come with the liquid, your standard tank is sold without any liquid and is thus not affected.
This doesn't sound right. Every piece of proposed legislation I've read states that tanks and cartridges can be max 2ml, end of story.

/u/altneurose Actually it does make a lot of sense, although I admit - by my personal interpretation of the TPD when I read it, I did make out that all tanks were limited to 2 ml. However check out this new Kanger tank:

As you can see it's labeled TPD compliant and it has 4 mil capacity.
What seems nonsensical and doesn't sound right is limiting all tanks to 2 mls. Why would they even do that? Then again, why would they limit bottles to 10 ml..
I think that with an EU directive what is in the directive does not become law in EU member states. Each state is expected to write their own law that complies with the directive. In the case of the UK and TPD I think I remember reading that they added the word "Disposable" to the line about tanks size limits.
One thing to note is that TPD will also make it very difficult for anyone who wants to sell their juice.
- All juice will have to list all constituents, this means getting mass spec analysis.
- You will also have to have emissions testing in regards to what in your vapour.
- Finally you will have to have toxilogical testing.
I spoke to a few companies doing this out of interest and the prices range from £3500 - £5000 per liquid.
At least it's not going to cost $1,000,000+ to merely apply for approval (with no guarantee of it being approved) for each individual nicotine strength and VG/PG ratio like it is in the United States.
I think its the same here also. To register a flavour It costs £220 per individual nicotine strength. So if you has a line of 10 flavours with 5 nicotine strengths it would cost in the region on £36,000 to £61,000 to apply for approval.
They could come back to you and say that all your flavours failed approval. :(
That clears it up so much. The 2ml capacity on tanks had me worried.
Another thing that popped into my head is that if the zero nic bottles aren't restricted by size I'd actually be more inclined to go for that, if it was a flavour I really, really liked. Thanks.
Anything on 70/72mg/ml bottles of 250ml-1L nicotine? Should I go ahead and buy a gallon of it now or nah?
