Day late and a dollar short. I live in indy as well, but I diy and this isn't really gonna effect me too much. However, some regulation is needed, all this juice on the market and people by it without fully knowing exactly what's in it. Is this the right way to handle it? No, but this fight is already over. Save your energy for the the bigger battles.
I'm not sure if you'll see my comment below, but you definitely need to know that posessing DIY e-juice will be punishable by a Class A infraction. This bill affects all Indiana vapers.
Yeah that's all fine, but let me know when they figure out how to enforce this. All the materials are food materials, easily and readily purchased online. Even law makers don't know how they can enforce it.
I mean, I'd prefer I don't respond with a personal horror story, so lets hope they don't decide to confiscate any and all e-juice because it could be unregulated in a regulated bottle. From my experience with 3 different Indiana counties: if there's money, there's a way. I just don't want to live in fear regarding my e-juice with any authority having the opportunity to decide whether my juice is legally bought or not. It's reminiscent of a society being worried if their cigarettes are regulated or not. There is no other sector involved with the FDA that will be as regulated as vaping. And I'm terrified.
Edit: I'm somewhat inebriated so I might not be expressing myself clearly. I just don't think me being someone who vapes is someone who should be prosecuted against. I'm all about regulation but not about unfair regulation. I don't mean to offend anyone and if one were to ask about my opinion I'd gladly respond with my thoughts and reasoning.
Apparently the bill makes it illegal to make your own juice at home for personal use. So diy can get you arrested.
Well, I'm not sure you can be arrested per se, but according to Indiana's laws, a Class A infraction, which is what one would receive if caught possessing e-juice that isn't from a certified manufacturer, has a maximum charge of up to $10,000. Now, I feel like that may only come about to repeated offenders, however it's still daunting. After this comes into effect (which I think is July?), treat your unregulated e-juice like it is - illegal. Dumb as fuck, I know, but it's the reality we have here now.
Here's the main question, though- Who is going to enforce this law? Let's say it's your average police officer. How are they going to enforce it? Will they have an ever-evolving list of Indiana-approved e-liquid brands? That seems like the simplest way to enforce things with regards to the average vaper.
Soooo... How about buying a single 30ml bottle of an approved liquid, then filling said bottle with your DIY juice? The only way I can see that backfiring is if they send your juice off for a lab analysis, and I just don't see that happening.
I'm pretty sure that the realities of this law will be as follows: the Indiana Tobacco and Alcohol commission will perform regular inspections of vape shops and their inventory, as well as inspecting any premises where e-liquid is manufactured. Any vape shop or e-liquid manufacturer found to be violating the law will be hit with the Class A infraction and subsequent fine. The average user will NOT be subjected to a random search to find out if their e-liquid is certified in the state of Indiana.
Obviously, you won't be able to just set up a kiosk at the flea market and sell off your DIY juice, and if you want to go commercial with your mixes, you'll have to jump through all the hoops. But if you're mixing up liquid for yourself and a couple of friends, I don't see the authorities having any interest in you at all.
